This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you visit our website or make a purchase. By using our site, you agree to the collection and use of information in accordance with this policy and applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec’s Act to modernize legislative provisions respecting the protection of personal information (Law 25).

1. Privacy Officer

We do not use automated decision-making processes that produce legal effects or similarly significant effects on you. Where we use aggregated or anonymized data for marketing personalization (such as product recommendations or targeted advertising), no individual profiling decisions are made without your knowledge and consent.

8. Sharing Your Personal Information

We may share your personal information only in the following circumstances:

Third-Party Service Providers: We work with trusted service providers who assist us in operating our business, including:

  • E-Commerce Platform: BigCommerce (Stencil) powers our online store and processes certain data on our behalf, including checkout, account management, and order processing.
  • Payment Processors: We accept payments via Visa, Mastercard, and American Express. These payment processors handle credit card and payment transactions securely. We do not store full credit card details on our servers.
  • Shipping Partners: Canada Post and other carriers receive delivery information necessary to fulfill your orders.
  • Analytics Services: We use Google Analytics to understand website usage and improve your experience. Google Analytics collects anonymized data about your browsing behaviour on our site. This script only loads after you consent to analytics cookies.
  • Email Marketing: We use Omnisend (formerly Soundest) to manage our email marketing campaigns, send newsletters, and deliver promotional communications to subscribers who have opted in. Omnisend may process your email address, purchase history, and browsing behaviour on our site to personalize communications. The Omnisend order-tracking script is consent-gated (cookie consent category 3 — Analytics/Targeting), and Omnisend’s storefront scripts are consent-gated (cookie consent category 2 — Functional). All Omnisend scripts require your consent before loading.
  • Web Fonts: We use Google Fonts to display consistent typography across our site. When our site loads, your browser makes requests to Google’s servers, which may receive your IP address.
  • Search Engine Tools: We use Google Search Console (via site verification) to monitor and maintain our site’s presence in Google Search results.

These third-party providers are contractually required to protect your information and may only use it for the specific purposes for which it was shared.

Legal Requirements: We may disclose your information when required by law, such as to comply with a subpoena, court order, or other legal process, or to protect our legal rights and safety.

Aggregated Data: We may share generic, aggregated demographic information that is not linked to any individual’s personal information with business partners for analytical purposes.

9. International Data Transfers

Your personal information may be transferred to and processed in countries outside of Canada, including the United States, where some of our service providers are located. Specifically, BigCommerce, Google (Analytics, Fonts, Search Console), and Omnisend operate servers in the United States and other jurisdictions. These countries may have different privacy laws than Canada.

ReelFlies.ca also operates an international version of our website at ReelFlies.com. If you access our services through either domain, your personal information may be processed in the same manner as described in this policy.

In accordance with PIPEDA and Quebec Law 25, before transferring personal information outside of Canada, we conduct a privacy impact assessment to ensure that the information will receive a comparable level of protection. We implement appropriate contractual and technical safeguards — including data processing agreements — to protect your privacy in these transfers.

A list of jurisdictions where your personal information may be processed is available upon request by contacting our Privacy Officer.

10. How We Protect Your Information

We implement industry-standard security measures to protect your personal information, including:

SSL/TLS Encryption: All sensitive data exchanged between your browser and our site is encrypted using SSL/TLS protocols.

PCI DSS Compliance: Our e-commerce platform (BigCommerce) is certified as a PCI DSS Level 1 compliant service provider, the highest level of payment card security compliance.

Access Controls: Access to personal information is restricted to authorized personnel who require it to perform their duties. Staff receive regular privacy and security training.

Regular Security Assessments: We regularly review and update our security measures to address emerging threats and vulnerabilities.

Privacy Impact Assessments: In accordance with Quebec Law 25, we conduct privacy impact assessments when implementing new information systems or technologies that involve personal information.

No method of data transmission over the Internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee absolute security.

In the event of a breach of security safeguards involving your personal information that creates a real risk of significant harm, we will:

  • Notify the Office of the Privacy Commissioner of Canada as required by PIPEDA

  • Notify affected individuals promptly with a description of the breach, the types of information involved, and steps you can take to reduce the risk of harm
  • Maintain a record of all data breaches as required by law

12. Your Privacy Rights

Under PIPEDA and Quebec Law 25, you have the following rights regarding your personal information:

Right to Access: You may request access to the personal information we hold about you.

Right to Correction: You may request that we correct any inaccurate or incomplete personal information.

Right to Withdraw Consent: You may withdraw your consent for any non-essential use of your personal information at any time.

Right to Data Portability: You may request a copy of your personal information in a structured, commonly used, and machine-readable format (such as CSV or JSON). We will fulfil portability requests within 30 days.

Right to Deletion: You may request the deletion of your personal information, subject to our legal obligations to retain certain records.

Right to File a Complaint: You have the right to file a complaint with us or with the applicable privacy authority (see Section 18 below).

13. Data Retention

We retain your personal information only as long as necessary to fulfill the purposes for which it was collected, or as required by law:

  • Marketing consent records: Until consent is withdrawn
  • Legal compliance records: As required by applicable laws
  • Breach notification records: Minimum 2 years as required by PIPEDA

When personal information is no longer needed, it is securely destroyed or irreversibly anonymized.

14. Marketing Communications and CASL Compliance

We comply with Canada’s Anti-Spam Legislation (CASL) for all commercial electronic messages.

Express consent is required before we send you marketing emails, newsletters, or promotional communications. We obtain express consent through clear opt-in mechanisms on our website, including our newsletter signup form.

Implied consent may apply for transactional communications related to a purchase you have made (valid for up to 2 years from the date of purchase) or an inquiry you have submitted (valid for up to 6 months from the date of inquiry).

Every marketing email we send includes:

  • Clear identification of ReelFlies.ca / Digital Barn Ltd. as the sender
  • Our mailing address and contact information
  • A simple and accessible unsubscribe mechanism

We process unsubscribe requests within 10 business days as required by CASL.

You may opt out of marketing communications at any time by:

  • Clicking the “unsubscribe” link included in every marketing email
  • Contacting our Privacy Officer directly

Opting out of marketing communications does not affect transactional emails related to your orders (such as order confirmations and shipping notifications).

15. Do Not Track Signals

Due to the lack of a consistent industry standard for interpreting “Do Not Track” browser signals, we do not currently alter our data collection practices in response to such signals. However, you can manage your privacy preferences through our cookie consent tool and your browser settings.
